TERMS & CONDITIONS

 

1. LEGALLY BINDING CONTRACT & ACCEPTANCE

1.1 These Terms & Conditions constitute a legally binding agreement between the customer and Yogi Travel World Ltd, governed exclusively by the laws of England and Wales, with exclusive jurisdiction of the English courts.

1.2 No contract shall exist until written confirmation of booking is issued by Yogi Travel World and cleared payment (deposit or full amount) is received.

1.3 By proceeding with payment, the customer is deemed to have read, understood, and irrevocably accepted these Terms in full.

1.4 Yogi Travel World reserves the absolute right to refuse, cancel, or decline any booking at its sole discretion, without obligation to provide justification or liability for consequential loss.

 

2. AGENCY STATUS & THIRD-PARTY RELATIONSHIP

2.1 Yogi Travel World acts either:

  • as principal (package arrangements), or
  • strictly as disclosed agent for third-party suppliers (flights, hotels, transport, tours, cruise and other products and services).

2.2 Where acting as agent, Yogi Travel World bears no responsibility or liability whatsoever for acts, omissions, defaults, insolvency, delays, or failures of the supplier.

2.3 All contractual obligations for service delivery rest exclusively with the relevant supplier. The customer’s sole legal recourse shall be against the supplier.

2.4 The customer expressly acknowledges that Yogi Travel World is not a carrier, hotel operator, or service provider unless explicitly stated in writing.

 

3. PAYMENT TERMS & DEFAULT

3.1 All bookings require immediate payment of a non-refundable deposit or full payment as specified at booking.

3.2 Failure to pay any balance by the due date shall constitute material breach of contract, entitling Yogi Travel World to:

  • cancel the booking without liability
  • retain all deposits
  • apply supplier cancellation charges

3.3 Final balances must be received no later than 15 days prior to departure, unless otherwise stated in writing.

3.4 Late bookings require immediate full payment and are strictly non-refundable.

3.5 Chargebacks or payment reversals initiated without lawful justification shall be treated as breach of contract and pursued for recovery of all losses, including legal and administrative costs.

 

4. PRICING, ERRORS & VARIATIONS

4.1 All prices are subject to change without notice until full payment and confirmation are completed.

4.2 Yogi Travel World reserves the unrestricted right to correct any pricing, availability, or system errors at any time prior to departure.

4.3 In the event of a pricing error, the customer shall be offered the option to:

  • accept corrected pricing, or
  • receive a full refund of monies paid (no further liability shall arise)

4.4 No compensation shall be payable for pricing adjustments or corrections.

 

5. CANCELLATION, AMENDMENTS & NON-REFUNDABILITY

5.1 All cancellations are subject to:

  • supplier cancellation policies, and
  • Yogi Travel World administrative fees

5.2 Deposits are strictly non-refundable in all circumstances unless expressly stated otherwise in writing.

5.3 Amendments are not guaranteed and are subject to availability, supplier permission, and additional charges.

5.4 Certain services (including but not limited to flight tickets once issued) are strictly non-changeable and non-refundable.

5.5 Refunds, where applicable, are strictly limited to amounts recoverable from suppliers.

 

6. LIMITATION OF LIABILITY (STRICT EXCLUSION CLAUSE)

6.1 To the fullest extent permitted by law, Yogi Travel World excludes all liability for:

  • indirect or consequential loss
  • loss of enjoyment
  • loss of profit, income, or opportunity
  • delays, cancellations, or disruptions
  • acts or omissions of third-party suppliers
  • force majeure events

6.2 Liability of Yogi Travel World, if established, shall in all circumstances be strictly limited to the total amount paid for the specific booking in question.

6.3 No liability shall arise for matters outside the direct and proven negligence of Yogi Travel World.

 

7. SUPPLIER FAILURE & INDEPENDENT LIABILITY

7.1 The customer expressly acknowledges that all third-party suppliers operate independently of Yogi Travel World.

7.2 Yogi Travel World shall not be liable for:

  • insolvency or bankruptcy of suppliers
  • failure to provide services
  • changes, cancellations, or disruptions by suppliers
  • quality or standard of supplier services

7.3 All claims arising from supplier failure must be pursued directly against the supplier concerned.

 

8. FINANCIAL PROTECTION

8.1 Yogi Travel World operates in accordance with applicable United Kingdom travel regulations. Where applicable, financial protection is provided through ATOL and/or ABTA coverage via our appointed suppliers, including but not limited to Brightsun Travel, Star Tours, and other licensed third-party providers, in order to ensure appropriate financial safeguarding for qualifying bookings. Details of the relevant supplier and protection arrangement applicable to a specific booking may be provided upon written request prior to confirmation of booking.

8.2 Yogi Travel World shall be responsible solely for errors directly attributable to its own negligence or administrative fault. In such circumstances, liability shall be strictly limited to a maximum aggregate compensation equivalent to the total booking value paid by the customer for flights and/or package services, plus an additional discretionary goodwill payment not exceeding £100.

8.3 Yogi Travel World shall not be held liable for any act, omission, insolvency, failure, or default of any third-party supplier, airline, tour operator, or service provider. All such claims, losses, costs, or damages arising from supplier failure shall be the sole responsibility of the relevant supplier, and customers are required to pursue any remedies directly with such third parties.

8.4 By confirming a booking with Yogi Travel World, the customer expressly acknowledges and agrees that responsibility for supplier-related performance rests with the respective supplier, and that Yogi Travel World shall bear no liability for such matters.

8.5 It is the customer’s responsibility to carefully review all booking confirmations and supporting documentation upon receipt. Any discrepancies, errors, or omissions must be reported in writing to accounts@yogitravel.world within 24 hours of booking confirmation. Failure to notify Yogi Travel World within this timeframe shall constitute acceptance of the booking as correct and final, and Yogi Travel World shall not be liable for any subsequent claims relating to errors or omissions not reported within the stated period.

 

9. CUSTOMER OBLIGATIONS (STRICT COMPLIANCE)

9.1 The customer is solely responsible for:

  • valid passports, visas, and entry requirements
  • health and vaccination compliance
  • travel documentation accuracy
  • timely arrival for all services

9.2 Failure to comply shall result in denial of travel without refund or liability.

9.3 Customers must verify all booking details immediately upon receipt and report discrepancies within 24 hours. Failure to do so constitutes irrevocable acceptance.

 

10. FORCE MAJEURE (FULL EXCLUSION)

10.1 Yogi Travel World shall bear no liability for any failure or disruption arising from circumstances beyond its reasonable control, including but not limited to:

  • war, terrorism, civil unrest
  • pandemics or epidemics
  • government restrictions or border closures
  • natural disasters
  • transport or infrastructure failures
  • industrial action

10.2 No refunds, compensation, or alternative arrangements shall be guaranteed in such circumstances beyond supplier entitlement.

 

11. INSURANCE (MANDATORY RESPONSIBILITY NOTICE)

11.1 Adequate travel insurance is strongly recommended and is the sole responsibility of the customer.

11.2 Yogi Travel World accepts no liability for losses that could have been insured against.

11.3 Yogi Travel World accepts no liability for any losses or damages.

 

 

12. COMPLAINTS, DISPUTES & LEGAL DEFENCE

12.1 Complaints must first be raised with the relevant supplier during travel.

12.2 Formal complaints must be submitted in writing within 14 days of return.

12.3 Any dispute shall be governed exclusively by English law and subject to the jurisdiction of English courts.

12.4 Yogi Travel World reserves the right to recover all legal, administrative, and defence costs incurred in responding to:

  • fraudulent claims
  • abusive chargebacks
  • baseless or malicious disputes

12.5 Minimum dispute defence recovery costs may include a fixed administrative/legal charge of £5,000, in addition to actual recoverable losses.

 

13. GENERAL PROTECTIONS

13.1 Yogi Travel World reserves the right to amend these Terms at any time without prior notice.

13.2 The latest published version shall apply to all bookings.

13.3 These Terms constitute the entire agreement between the parties and supersede all prior representations or communications.

13.4 No oral representations shall be binding unless confirmed in writing by an authorised representative.

 

14. COPYRIGHT & INTELLECTUAL PROPERTY

14.1 All website content, flyers, leaflets branding, digital materials, itineraries, and intellectual property are owned exclusively by Yogi Travel World and are protected under UK copyright law and international intellectual property legislation.

14.2 No material may be copied, reproduced, stored, transmitted, or commercially exploited without prior written consent.

14.3 Unauthorised use shall constitute infringement and may result in legal proceedings and recovery of damages and legal costs.

 

15. DATA PROTECTION & PRIVACY STATEMENT

15.1 Yogi Travel World processes personal data strictly in accordance with the UK General Data Protection Regulation (UK GDPR) and all applicable UK data protection laws. Personal data is processed only where there is a lawful basis, including contractual necessity, legal obligation, or explicit consent.

15.2 We implement appropriate technical and organisational security measures to protect personal data against unauthorised access, alteration, disclosure, loss, or destruction.

15.3 Customers may withdraw marketing consent at any time by submitting a written request to our official correspondence address. Withdrawal of consent shall not affect the lawfulness of processing carried out prior to withdrawal.

15.4 Yogi Travel World shall not be liable for unauthorised access arising from circumstances beyond reasonable control, including but not limited to cyber incidents not attributable to gross negligence.

 

16. PHOTOGRAPHY, VIDEO & MEDIA RIGHTS

16.1 Customers may capture photographs and video recordings during tours, provided such activity is conducted respectfully and does not interfere with the experience, safety, or privacy of others.

16.2 Yogi Travel World reserves the absolute right to require cessation of any recording activity deemed intrusive, disruptive, or inappropriate. Failure to comply may result in removal from the tour without refund or liability.

16.3 Customers are solely responsible for ensuring they have obtained appropriate consent from any individuals included in their personal media content prior to sharing, publishing, or distributing such content.

16.4 Yogi Travel World accepts no liability for the use, publication, or distribution of customer-generated media content.

16.5 Yogi Travel World and its authorised representatives may capture photography and/or video content for marketing, operational, or promotional purposes. Customers who do not wish to appear must notify the Tour Manager in writing at the commencement of the tour. No retrospective claims or objections shall be accepted.

 

17. BROCHURE & WEBSITE ACCURACY

17.1 All information published by Yogi Travel World, including but not limited to brochures, websites, itineraries, and marketing material, is provided in good faith and is accurate at the time of publication.

17.2 Yogi Travel World shall not be held liable for any inaccuracies, omissions, or changes arising from supplier updates, operational adjustments, or circumstances beyond its control, including force majeure events.

17.3 All descriptions of accommodation, facilities, transport, and destinations are subject to change without prior notice.

17.4 Customers are expressly advised to verify all critical travel information directly with Yogi Travel World prior to final booking confirmation.

 

18 SPECIAL DISCOUNTS

Discounts apply strictly as promotional incentives and are:

  • non-transferable
  • non-exchangeable
  • non-redeemable for cash
  • subject to availability

18.1 Discounts apply only to base tour cost and expressly exclude all ancillary services, including but not limited to flights, seat supplements, visas, transfers, insurance, and optional excursions.

18.2 Promotional allocations are strictly limited and may be withdrawn, amended, or terminated at any time without prior notice or liability.

18.3 Discounts are valid only upon receipt of cleared full payment within the specified promotional period.

18.4 Yogi Travel World reserves the absolute right to correct pricing or promotional errors at any time.

18.5 Any amendment, cancellation, downgrade, passenger removal, or name change shall automatically invalidate any applied discount, and standard pricing shall apply retrospectively.

18.6 Promotional offers cannot be combined unless expressly stated in writing by Yogi Travel World.

18.7 Certain tours, including long-haul, specialist, or third-party operated itineraries, may be excluded from promotional eligibility at Yogi Travel World’s sole discretion.

 

19 REDUCED DEPOSIT SCHEME

19.1 Reduced deposit payments are offered strictly as a booking incentive and are:

  • strictly non-refundable
  • strictly non-transferable
  • forfeited in all cancellation scenarios

19.2 Failure to pay the outstanding balance by the contractual due date constitutes material breach, resulting in automatic cancellation without liability to Yogi Travel World.

19.3 Standard cancellation charges apply in full regardless of deposit structure.

19.4 Any amendment or change to the booking may require the deposit to be increased to the standard deposit level, and any promotional benefits shall be withdrawn.

19.5 This scheme is limited to selected tours only and may be withdrawn or restricted without notice.

19.6 Issuance of visa support documentation does not alter refund or cancellation restrictions under any circumstances.

 

20 PROMOTIONAL OFFER – TOUR DISCOUNT

20.1 This offer is strictly limited to validated original physical tickets or authorised electronic verification.

20.2 Each ticket is strictly single-use and non-redeemable after validation.

20.3 Any duplication, alteration, misuse, or suspected fraud shall result in immediate refusal of the offer without liability.

20.4 The offer:

  • has no cash value
  • is non-transferable
  • cannot be combined with any other promotion
  • is subject to availability and capacity limits

20.5 Yogi Travel World reserves the right to withdraw or terminate this offer at any time without notice or liability, including where submissions are made after withdrawal.

20.6 All bookings remain subject to standard Terms & Conditions.

 

21 LOYALTY SCHEME

21.1 Loyalty rewards are discretionary promotional benefits with no cash value and do not constitute contractual consideration.

21.2 Points:

  • are non-transferable
  • cannot be exchanged for cash
  • expire 24 months after issuance
  • are subject to withdrawal or amendment at any time

21.3 Yogi Travel World reserves the absolute right to:

  • suspend or terminate accounts
  • revoke points without notice
  • amend redemption values at any time

21.4 Loyalty rewards are not applicable to third-party bookings, discounted promotions, or amended/cancelled tours.

21.5 In the event of cancellation or refund, any previously awarded points shall be automatically revoked.

 

22 FRONT SEAT BOOKINGS

22.1 Front seat reservations are subject to availability and are charged optional extras.

22.2 Once confirmed, front seat bookings are:

  • strictly non-refundable
  • strictly non-transferable
  • subject to 100% cancellation charge

22.3 Yogi Travel World reserves the right to reallocate seating at its sole discretion for operational, safety, or logistical reasons, with or without notice.

22.4 No guarantee is provided regarding seating position following any amendment or rescheduling.

22.5 Front seats do not constitute premium service or enhanced comfort.

22.6 Customers must comply with all safety instructions, including mandatory seatbelt use.

22.7 Yogi Travel World reserves the right to restrict eligibility for front seat allocation based on safety, medical, or operational considerations.
